ÖSYM stated in the Electronic Foreign Language Exam application guide that disabled people will not be accepted to the exam place even if they have applied to. Association of Visually Impaired in Education sued ÖSYM at the state council claiming that it is causing injustice and discrimination and lost the case. Therewith, ÖSYM claimed 1.800 TL from the association and they paid the full money in coins.
Board of Management member Merve Erten who spoke at the public statement in front of ÖSYM where association members came saying "We are here to pay our debt." stated that, "This exam has been conducted since 2014. However, ÖSYM did not accept disabled people in the last two years and they are saying "You cannot take this exam." by violating both the national and international legislations. UN's Convention on the Rights of Persons with Disabilities has Universal Design Principles which we became a party to, and those principles stipulate that a service in its design process should be organized in a way that every single person can benefit from it. On the other hand, ÖSYM claimed that even though two and a half year has passed, the exam format is new and they are continuing their work for disabled people. ÖSYM also stated that there is no injustice since there is no drawback for disabled people to attend paper and pen foreign language exams. However, that is not the truth because with a recent change, an applicant can attend digital exams four times a year and paper and pen exams two times a year which means they can attend this foreign language exam six times a year while a disabled person can only attend the paper and pen exam two times a year.”.
Erten who stated that they appealed the decision for correction expressed that, “We, as disabled people, do not want to lose our faith in solving the problems we are facing with the help of the judgement since our rights are secured with legislations. If we cannot get results with this way, we will try different ways such as applying to Supreme Court and European Court of Human Rights.”.
Erten underlined that ÖSYM can legally demand the money and they came to ÖSYM center to pay their debt. She said, “ ÖSYM demanded 1.800TL and informed that if we do not pay the debt, they will commence execution proceedings. We wanted to pay that money by coming here in person. For that reason, we will pay the full amount in coins. However, as a response to ÖSYM’s demand of money right after the case result, we demand acceptance of disabled people to Electronic Foreign Language Exam as soon as possible.” and ended her statement.
After that, association members went to ÖSYM’s pay office and paid their debt in 1.800 coins.
